General Terms and Conditions of Sale

Article 1 – Seller Information

The website philmonmar.shop and the “Philmonmar” online shop are operated by Maricus Philmon, a sole proprietor trading under the name Philmonmar.

Legal form: Sole proprietorship. Legal company name: Sole proprietorship. Owner: Maricus Philmon. Business identification number provided by the seller: SSN 505-13-8553. Registered address and return address: 4607 Pierce St NE, Minneapolis, Minnesota 55421, United States.

Article 2 – Scope and Acceptance

These General Terms and Conditions of Sale govern all purchases of products made through philmonmar.shop. They apply to consumers and, where relevant, business customers, subject to any mandatory laws applicable to the customer.

By placing an order, the customer confirms that they are legally capable of entering into a contract, have reviewed the product description, price, delivery information, return policy and these terms, and accept them without reservation. The version in force when the order is submitted applies to that order.

Article 3 – Products and Availability

The essential characteristics of each product are presented on its product page. Photographs and illustrations are provided for identification purposes and may show minor differences in color or appearance caused by lighting, screen settings or manufacturing variations. Such minor differences do not affect the customer’s statutory rights.

Products are offered subject to availability. If a product becomes unavailable after an order is placed, Philmonmar will notify the customer promptly and will either offer a suitable alternative, with the customer’s express agreement, or cancel and refund the unavailable item.

Article 4 – Prices, Taxes and Charges

Prices are displayed in United States dollars unless another currency is expressly shown at checkout. The applicable product price is the price displayed when the customer submits the order. Philmonmar may change prices at any time, but changes will not affect orders already accepted.

Applicable sales taxes, value-added taxes, shipping charges and other mandatory fees are displayed before the customer confirms payment. For international deliveries, customs duties, import taxes and local processing fees may be charged by the destination country. Unless checkout expressly states that these charges are included, they are payable by the customer and are not controlled by Philmonmar.

If an obvious pricing or technical error occurs, Philmonmar may contact the customer before shipment to request confirmation at the correct price or cancel the affected item and issue a full refund. Philmonmar will not charge a corrected price without the customer’s express agreement.

Article 5 – Orders and Contract Formation

The customer selects the products, verifies the cart, provides accurate billing and delivery information, selects an available delivery and payment method, and submits the order using the checkout button that clearly indicates an obligation to pay. The customer may review and correct order details before submission.

After submission, Philmonmar sends an electronic acknowledgment to the email address provided by the customer. This acknowledgment confirms receipt but does not necessarily constitute acceptance. The sales contract is formed when Philmonmar sends an order confirmation or dispatch confirmation, whichever occurs first.

Philmonmar may refuse or cancel an order for legitimate reasons, including product unavailability, an obvious error, suspected fraud, unauthorized payment, incomplete or inaccurate information, delivery restrictions, sanctions compliance, or a previous unresolved payment dispute. If payment has already been collected for a canceled order, the corresponding amount will be refunded to the original payment method.

The customer must provide complete and accurate contact, billing and delivery information. Philmonmar is not responsible for delays or additional costs resulting from incorrect information supplied by the customer.

Article 6 – Payment

Available payment methods are displayed at checkout and may include major credit or debit cards and other payment methods supported by Stripe. Payment is processed securely by Stripe or another payment service provider identified at checkout. Philmonmar does not store complete payment-card numbers.

Payment is due in full when the order is submitted and may be authorized or captured at that time. The customer confirms that they are authorized to use the selected payment method. Card and bank statements may show “PHILMONMAR” or a substantially similar descriptor.

All transactions are subject to authorization, fraud-prevention checks and the payment provider’s terms. If payment is declined or cannot be verified, the order may be suspended or canceled. Philmonmar will never request complete card details by email or telephone.

Article 7 – Delivery

Available delivery methods, estimated delivery times and shipping charges are displayed at checkout before payment. Orders are generally processed within one to three business days. Estimated transit times are three to seven business days for deliveries within the contiguous United States and seven to twenty business days for other supported destinations, unless a different estimate is stated at checkout.

Delivery estimates are not guaranteed unless an expressly guaranteed service is purchased. Delays may occur because of carriers, customs, weather, peak periods, public holidays, address issues or events beyond Philmonmar’s reasonable control. If a legally binding delivery deadline applies, the customer retains all remedies provided by mandatory consumer law.

Delivery is made to the address entered during checkout. The customer must promptly check tracking information and report any apparent loss or delivery problem. Risk of loss passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the products, except where applicable law provides otherwise.

If a parcel is returned because of an incorrect address, refusal, non-collection or another reason attributable to the customer, Philmonmar may deduct reasonable return and reshipment costs from any refund, except where prohibited by law. If a parcel is lost or materially damaged in transit, the customer should contact [email protected] so that Philmonmar can investigate and provide a replacement or refund as appropriate.

Article 8 – Right of Withdrawal and Return Policy

Consumers may withdraw from an eligible purchase without giving a reason within fourteen calendar days after the day on which the customer, or a third party designated by the customer other than the carrier, receives the product. For orders containing products delivered separately, the period begins when the last product is received. This fourteen-day policy also applies as Philmonmar’s standard return period where no statutory withdrawal right exists.

To exercise the right of withdrawal, the customer must send a clear statement identifying the order and the decision to withdraw to [email protected] before the withdrawal period expires. The customer may also contact Philmonmar by telephone at +1 (402) 312-8790, but written notice by email is recommended.

After giving notice, the customer must return the product within fourteen calendar days to: Philmonmar, Attn: Returns, 4607 Pierce St NE, Minneapolis, Minnesota 55421, United States. The customer should use a trackable shipping service and retain proof of shipment.

Returned products must be handled only to the extent necessary to establish their nature, characteristics and functioning. The customer may be responsible for any diminished value resulting from handling beyond what would reasonably be permitted in a physical shop. Unless the product is defective, incorrect or damaged in transit, direct return shipping costs are the customer’s responsibility.

Philmonmar will refund eligible payments to the original payment method, including standard outbound delivery charges where required by law. Any extra amount paid for expedited or non-standard delivery is not refundable unless required by law. The refund will be initiated within fourteen days after receiving the withdrawal notice, but Philmonmar may withhold it until the returned product is received or the customer provides proof of shipment, whichever occurs first. Financial institutions may require additional time to post the credit.

The right of withdrawal does not apply where a lawful exception applies, including products made to the customer’s specifications or clearly personalized, products liable to deteriorate or expire rapidly, sealed products unsuitable for return for health-protection or hygiene reasons once unsealed, sealed audio, video or software products once unsealed, digital content supplied immediately after the customer’s express consent and acknowledgment of loss of the withdrawal right, or services fully performed with the customer’s prior express consent. These exceptions apply only to the extent permitted by applicable law.

Article 9 – Refunds, Exchanges and Cancellations

Before dispatch, customers may request cancellation by emailing [email protected]. Philmonmar will make reasonable efforts to stop processing, but cancellation cannot be guaranteed after fulfillment or shipment has begun. If shipment cannot be stopped, the customer may use the withdrawal and return procedure described above.

Exchanges are subject to product availability. Philmonmar may process an exchange as a return and a new order. Approved refunds are issued only to the original payment method, except where that method is unavailable and applicable law permits another method. Philmonmar does not charge a refund processing fee.

Article 10 – Legal Guarantees and Product Conformity

Philmonmar warrants that products will correspond materially to their descriptions, be of satisfactory quality, be free from material defects upon delivery and be reasonably fit for their ordinary purpose, subject to normal wear, proper use and any limitations clearly disclosed before purchase.

Customers benefit from all non-excludable statutory guarantees and remedies applicable in their place of residence. Depending on the applicable law and circumstances, remedies for a defective, damaged, incorrect or non-conforming product may include repair, replacement, price reduction, contract cancellation or a refund.

Any voluntary or manufacturer’s warranty shown on a product page is additional to, and does not replace or restrict, statutory consumer rights. Warranty coverage does not extend to normal wear and tear, accidental damage after delivery, misuse, neglect, unauthorized modification, failure to follow care instructions or damage caused by improper storage or maintenance.

To make a guarantee claim, the customer should contact [email protected] with the order number, a description of the issue and, where reasonably possible, photographs or other supporting information. Philmonmar may request the return of the product and will provide appropriate instructions. Philmonmar bears reasonable return costs for products confirmed to be defective, damaged, incorrect or non-conforming.

Article 11 – Complaints and Customer Service

The customer should include their name, order number, contact details, a clear description of the issue and the requested resolution. Philmonmar aims to acknowledge complaints within two business days and provide a substantive response within ten business days. Complex carrier, payment or warranty investigations may require additional time.

Customers are encouraged to contact Philmonmar before initiating a payment dispute or chargeback so that the issue can be investigated and resolved promptly. This does not limit any right to contact the payment provider, card issuer, consumer-protection authority or court.

Article 12 – Liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, or breach of mandatory consumer rights.

To the extent permitted by law, Philmonmar is not liable for indirect or unforeseeable losses, business losses suffered by a consumer, or failures caused by events beyond its reasonable control. For business customers only, Philmonmar’s aggregate liability arising from an order will not exceed the amount paid for that order, except where such a limitation is prohibited by law.

Article 13 – Force Majeure

Philmonmar is not responsible for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, severe weather, fire, epidemic, war, civil disturbance, government action, labor disputes, transportation interruption, carrier failure, telecommunications outage or supply-chain disruption. Philmonmar will notify affected customers where reasonably possible and take reasonable steps to reduce the impact. Mandatory cancellation and refund rights remain unaffected.

Article 14 – Personal Data and Payment Security

Personal data is processed as necessary to manage orders, payments, delivery, returns, customer service, fraud prevention and legal obligations, in accordance with the privacy policy available on philmonmar.shop. Payment information is transmitted securely to Stripe or the payment provider shown at checkout and is handled under that provider’s security and privacy standards.

Article 15 – Applicable Law and Disputes

These terms and all sales made by Philmonmar are governed by the laws of the State of Minnesota and applicable federal laws of the United States, without regard to conflict-of-law principles. If the customer is a consumer residing outside Minnesota, this choice of law does not deprive the customer of mandatory protections available under the law of their habitual residence.

The parties will first attempt in good faith to resolve any dispute through direct communication. If no amicable resolution is reached, either party may bring proceedings before a court having jurisdiction under applicable law. Consumers may bring claims in any court available to them under mandatory consumer-protection rules. Nothing in these terms requires a consumer to waive access to a court, participate in mandatory arbitration, or waive participation in a class or collective action where such a waiver would be unlawful.

Article 16 – Severability and Changes

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in effect, and the affected provision will be applied to the maximum extent permitted by law. A failure by Philmonmar to enforce a provision does not constitute a waiver of that provision.

Philmonmar may update these terms for future orders to reflect legal, operational or commercial changes. Updated terms become effective when published on philmonmar.shop and do not retroactively alter orders already accepted, unless a change is required by law or expressly agreed with the customer.
